Question: Why should I register my work if copyright protection is automatic?

Answer:Registration is recommended for a number of reasons. Many choose to register their works because they wish to have the facts of their copyright on the public record and have a certificate of registration. Registered works may be eligible for statutory damages and attorney's fees in successful litigation. Finally, if registration occurs within 5 years of publication, it is considered prima facie evidence in a court of law.

Know-How

Definition:
Information that enables a person to accomplish a particular task or to operate a particular device or process.

Publisher Statement

Definition:
Text printed in each issue of a serial providing information such as the publication name, owner, staff, and frequency. This is generally found within the first few pages of text.

Counterfeit

Definition:
In general, counterfeit goods are copied and packaged to resemble genuine/legitimate goods as closely as possible. The legitimate producer's trademarks and logos are reproduced in order to deceive consumers into thinking they are buying the genuine merchandise.

Generic Term

Definition:
Terms that the relevant purchasing public understands primarily as the common or class name for the goods or services. These terms are incapable of functioning as trademarks denoting source, and are not registrable on the Principal Register under §2(f) or on the Supplemental Register.

Novelty

Definition:
One of the three conditions that an invention must meet in order to be patentable. Novelty is present if every element of the claimed invention is not disclosed in a single piece of prior art.

Equivalents, Doctrine Of

Definition:
A rule of claim interpretation under which a product or process, although not a literal infringement, is still an infringement if it performs substantially the same way as the patented invention.
