Answer: Eligibility: To be eligible for preregistration, it is required that: creation and fixation of the literary work must have already commenced; the claimant in the work can verify that he has a reasonable expectation that the work will be commercially distributed in the form of a book.

Answer: "Copyright protects ""original works of authorship"" that are fixed in a tangible form of expression. The fixation need not be directly perceptible so long as it may be communicated with the aid of a machine or device. Copyrightable works include the following categories: literary works; musical works, including any accompanying words dramatic works, including any accompanying music pantomimes and choreographic works pictorial, graphic, and sculptural works motion pictures and other audiovisual works sound recordings architectural works "

 

Question: I’ve heard about a poor man’s copyright. What is it?

Answer: "The practice of sending a copy of your own work to yourself is sometimes called a poor man’s copyright. There is no provision in the copyright law regarding any such type of protection, and it is not a substitute for registration. "

Definition:
A proceeding before the Trademark Trial and Appeal Board in which the plaintiff seeks to cancel an existing registration of a mark. The proceeding may only be filed after issuance of a registration. A petition for cancellation may be filed by any person who believes that he or she is or will be damaged by the registration of the mark.
